1. What Information We Collect About You When You Visit our Websites

Log Files

When you view content provided by us, our Hubspot platfor automatically collect information about your computer hardware and software. This information can include your IP address, browser type, domain names, internet service provider (ISP), the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, clickstream data, access times and referring website addresses. This information is used to provide general statistics regarding use of the Websites. For these purposes, we do link this automatically-collected data to other Personal Information such as name, email address, address, and phone number.

Use of Navigational Information

We use Navigational Information to operate and improve the Websites and to provide you with a better experience. We may also use Navigational Information alone or in combination with Personal Information to provide you with personalized information. Navigational Information, such as IP address, is used to approximate your location. For example, we may use your approximate location to provide content that has been translated or send emails at certain times using your local time zone.

You may disable the collection and use of your location data through browser-, operating system- or device-level settings. Consent concerning location data may be withdrawn at any time by contacting us.

Customer Testimonials and Comments

We post customer testimonials and comments on our Websites, which may contain Personal Information. We obtain each customer’s consent via email prior to posting the customer’s name and testimonial.

If you give us Payment information, we use it solely as authorized by you in accordance with this Privacy Policy in order for you to use the Subscription Services, including to check your financial qualifications and collect payment from you. We use a third-party service provider to manage credit card processing. This service provider is not permitted to store, retain, or use information you provide except for the sole purpose of credit card processing on our behalf.

Our Websites provide links to other websites of third parties. We do not control, and are not responsible for, the content or practices of these other websites. This Privacy Policy does not apply to these other websites, which are subject to any privacy and other policies they may have.

Retention of Personal Information

How long we keep information we collect about you depends on the type of information, as described in further detail below. After such time, we will either delete or anonymize your information or, if this is not possible, then we will securely store your information and isolate it from any further use until deletion is possible.

We retain Personal Information that you provide to us where we have an ongoing legitimate business need to do so (for example, as needed to comply with our legal obligations, resolve disputes and enforce our agreements).

When we have no ongoing legitimate business need to process your Personal Information, we securely delete the information or anonymise it or, if this is not possible, securely store your Personal Information and isolate it from any further processing until deletion is possible. We will delete this information at an earlier date if you so request, as described in the «How to Access & Control Your Personal Data» below.

If you have elected to receive marketing communications from us, we retain information about your marketing preferences for a reasonable period of time from the date you last expressed interest in our content, products, or services, such as when you last opened an email from us. We retain information derived from cookies and other tracking technologies for a reasonable period of time from the date such information was created

This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Bember App, and how we comply with the EU General Data Protection Regulation (GDPR).

Please note: If you are a demo user of the Bember App, please see section 8 below for specific information about the processing of personal data in this context.

2. Personal data collected

When you use the Bember App, certain personal data is required to offer you a full range of services.

This information includes (depending on the specific services provided by your employer/landlord):

  • Name, Email, and Phone Number: Provided by your employer or the landlord to create and manage your user account. This basic contact information facilitates communication and ensures a personalized experience within the Bember App.
  • Payment Information: For transactions related to supplementary services through [App Name], payment information is collected to process purchases efficiently. This may include credit card numbers, billing addresses, and other payment-related details.
  • Picture/Profile Information: To enhance user interaction and identification within the Bember App, we may collect your picture or other profile information. This helps in personalizing your app experience and may be used for identification in access control or other app functionalities.
  • Messages: If the Bember App includes messaging or communication features, we collect the content of messages sent and received through the app to facilitate these communications.
  • Interactions with building automated systems: Information on your use of access control systems, data on your preferences and usage of environmental controls within the building, and any adjustments made through the Bember App.

3. Data controller

Bember provides you with access to the Bember App and its functionalities as a service provider, subject to an agreement with either the landlord of your employer, or directly with your employer. This means that Bember acts as a data processor in providing you with the Bember App, and that your employer or landlord will act as a data controller and be primarily responsible for the processing of your personal data through the Bember App.

Bember will only process your personal data subject to the instructions of the data controller. If you have any questions regarding your rights or require further information, you should consult your employer.

For supplementary services facilitated through the Bember App, such as rental of parking space, EV charging and purchase of products, the relevant provider offering the specific service will normally act as the data controller for those transactions. Bember will provide further information required by privacy laws in connection with such transactions.

4. Purpose and legal basis for the processing

Bember only processes your personal data for the purposes of providing you with functionality through the Bember App, and to comply with our obligations under the agreement with your landlord or employer.

Your employer or landlord is, as the data controller, responsible for ensuring and documenting a legal basis for the processing of your personal data. Any inquiries regarding the legal basis for the relevant processing activities or retention periods should be directed to your employer.

5. Data Sharing and Disclosure

Bember will not share or disclose your personal data for its own purposes, other than as set out in the agreement with your employer or landlord. Your employer or landlord, acting as the data controller, may have access to certain personal data related to your use of the Bember App. This access is governed by their role in providing you with entry to the premises and facilitating your use of functionality in the Bember App.

In instances where supplementary services are purchased, necessary information will be shared with the respective service provider acting as the data controller to facilitate the transaction and service provision.

Bember may also disclose personal data with

  • Payment Service Providers: To facilitate transactions for supplementary services within the Bember App, such as parking space rentals or food purchases, we share necessary payment information with payment processors and banks, acting as independent data controllers. This ensures secure and efficient processing of your transactions.
  • Cloud Storage and IT Service Providers: To ensure the reliable operation of the Bember App, we utilize cloud storage solutions and IT service providers for data hosting, maintenance, and backup. This ensures your data is securely stored and accessible when needed.

  • Purpose of the processing: Your personal data is collected to provide you with access to the demo version of the Bember App, which includes showcasing the app’s functionalities and features. In addition, Bember may process your personal data for marketing purposes and to conduct surveys or collect feedback to improve our services. This may include sending you information about our products, offers, and news about the Bember App and invite you to participate in surveys or request your feedback to help us enhance our app and services.
  • Types of personal data collected: We may collect basic personal information such as name, email address, payment information, information about how you interact with the Bember App and other contact details to create your demo account and facilitate communication.
  • Legal basis for the processing: The processing of your personal data is based on the necessity for the performance of a contract to which you are party (the Bember End User License Agreement) cf. GDPR art. 6 nr. 1 c).
